STRATEGIC AND CONVINCING IN COMPETITION

We were summoned to appear before the court by our competitor Bitė. This was an interesting one. Tele2 and I were accused of violation of business reputation, damage to their company’s image and unfair competition. Sounds pretty serious. One could expect to spend some time behind bars for this.

However, the lawyers had a different opinion and strategically worked everything out so that the claim was eventually dismissed. Upon hearing their argument, the court defended the freedom of speech and stated that an opinion on competitors can be given if supported by facts. This conclusion was very important to us, because otherwise it would have dealt a serious blow to the competition on the market.

INSIGHTS AND SOLUTIONS BEYOND THE SCOPE OF LEGAL ASSISTANCE

Our business growth opportunities were limited by unfair competition. The wrongful public procurement practices in the railway sector were also contrary to the public interest. The situation was unprecedented in Lithuania and it was not clear whether it was a legal or political issue. How do we get to the root of it? How do we deal with this challenge? What reasoning can we offer?

WINT managed to look at the situation on a larger scale and took a broader approach by giving examples of other European countries and dealing with an unprecedented case in Lithuania. They were patient and persistent and carried through to the end. Today, we are very grateful for this. Their insight and excellent work led to a favourable court decision, which opened the way for suppliers to the public procurement in this sector, thus ensuring fair competition and public interest.
